Internal access to any client project data, files, communications, credentials, or sensitive business information is restricted on a strict need-to-know basis, limited exclusively to the specific team members, project managers, designers, developers, and marketing specialists actively assigned to work on the particular client project. The deliverables subject to ownership transfer may include custom website source code, application source code, custom graphic designs and visual assets, logos and brand identity elements created exclusively for the client, written content and copy created specifically for the client's project, and other project-specific work products as explicitly specified and agreed upon in the written project agreement or statement of work. Until full payment in cleared funds is received and confirmed by LevelUp Solution, all right, title, and interest in and to all work created, including all intellectual property rights therein, remains exclusively vested in LevelUp Solution, and the client has no right to use, distribute, publish, or exploit the work in any manner. Even after the formal transfer of ownership of final deliverables to the client, LevelUp Solution irrevocably retains full and exclusive ownership of all pre-existing intellectual property, including but not limited to proprietary development frameworks, reusable code libraries and components, design systems and component libraries, UI kits, functional templates, development methodologies, internal processes and workflows, tools and utilities, third-party licensed components incorporated with appropriate licenses, and any other assets that were developed, created, or acquired by LevelUp Solution independently of the specific client project and that may have been used or incorporated in the creation of the deliverables. In such cases, the client receives a perpetual, irrevocable, non-exclusive, non-transferable, royalty-free license to use such pre-existing components solely as integrated into and as part of the specifically delivered project and for the project's intended purpose, but not to extract, repurpose, relicense, resell, or use them independently of the delivered project. LevelUp Solution also retains the perpetual right to use non-confidential aspects of project outcomes, including but not limited to website screenshots, application interface screenshots and videos, design mockups and visual samples, high-level performance metrics and results achieved (without revealing confidential business data), general project descriptions and case narratives, and client testimonials provided with consent, to showcase our capabilities, expertise, and track record in our portfolio, company website, social media accounts, professional proposals, conference presentations, award submissions, press releases, media appearances, and other marketing and promotional materials, unless the client has submitted a formal written request for portfolio exclusion prior to the commencement of the project and such request has been explicitly acknowledged, accepted, and confirmed in writing by an authorized representative of LevelUp Solution.

Once a client project has formally and officially commenced following the signing of a project agreement, receipt of the advance payment, kickoff meeting or call, and the beginning of any billable work activity including but not limited to project planning, requirements analysis, research, strategy development, design conceptualization, wireframing, design mockups, front-end development, back-end development, content creation, campaign setup, or any other service-specific activity, refunds will generally not be issued or considered for any work that has already been completed, time that has already been invested, resources that have already been allocated and committed, or third-party costs that have already been incurred or contractually committed. If a client wishes to cancel a project at any stage after work has commenced, they remain responsible for paying the full cost of all work completed up to the point of cancellation, all third-party costs already incurred (including but not limited to domain registration fees, hosting activation fees, premium theme or plugin licenses purchased, stock image licenses, advertising account setup costs, or any other out-of-pocket expenses), any applicable cancellation or early termination fees as specified in the project agreement, and all outstanding invoices for any milestone payments that have become due. Refunds are definitively and absolutely not available for the following categories of services once those services have been initiated, delivered, or substantially performed: search engine optimization (SEO) services of any type, social media marketing and management services, paid advertising management services (Google Ads, Meta Ads, and other platforms), email marketing services, content marketing and content creation services, digital marketing strategy and consulting services, graphic design work of any type or complexity once design concepts have been presented, completed website pages or sections that have been delivered and approved, developed application features or modules that have been delivered and approved, completed or substantially completed custom software or app development work, and any other service that has been substantially performed or delivered. All refund requests, regardless of the circumstances, must be submitted formally in writing via email to hello@levelupsolution.in with the subject line clearly stating "Refund Request - [Project Name]," and must include a detailed explanation of the specific reason or reasons for the request, supported by any relevant evidence or documentation. Requests must be submitted within 7 calendar days of the relevant payment date. The categories of information we typically collect, receive, and process during the onboarding phase include the following. Business identity and legal information including your company's full legal name, business registration details, GST registration number, incorporation documents or business ownership details, and relevant regulatory or compliance information specific to your industry. Brand assets and identity materials including high-resolution logo files in multiple formats (SVG, PNG, AI, EPS, PDF), brand color palettes with Hex, RGB, CMYK, and Pantone codes, typography specifications and font files, brand guidelines documents, tone of voice guidelines, photography and imagery style guides, and any existing brand identity materials. All information, assets, credentials, and data received during the onboarding phase is subject to the strictest level of confidentiality, security, and privacy protection that LevelUp Solution applies to client data. Specific security measures applied to onboarding data include: access credentials are immediately stored in our enterprise-grade, zero-knowledge, end-to-end encrypted password management system and are never stored in plain text, in email threads, in chat messages, or in any unencrypted format; access to each set of credentials is restricted exclusively to the specific team members actively assigned to work on the relevant aspect of the project; all credential access is logged and monitored with full audit trails; credentials are transmitted using secure, encrypted channels and never via unsecured methods; a comprehensive onboarding checklist is maintained for each project to ensure that all required information is collected systematically and nothing is overlooked; a dedicated and password-protected project workspace is created for each client in our project management platform to organize and centralize all project-related information and communication; and upon formal project completion, our team will perform a thorough credential review and will either return, revoke, or securely delete all client credentials as appropriate and as requested by the client. All significant business decisions affecting our clients and users, including decisions about accepting or declining projects, pricing and contract terms, service suitability assessments, and account management decisions, are made by our human team members using their professional expertise, experience, and judgment, informed by but not exclusively determined by data and analytics. Our use of data analytics and profiling tools, such as website analytics, behavioral tracking, and audience segmentation tools, is limited to the purpose of understanding aggregate patterns and trends to improve our website, services, and marketing effectiveness, and to deliver more relevant content and advertising to potential clients. These profiling activities inform our marketing strategies and content decisions but do not result in automated individual decisions that significantly affect any specific person's legal rights, economic situation, or other significant aspects of their life.
